Welcome to the LightRemit Mobile Application. Please read these terms and conditions of service (“End-User Terms and Conditions”) carefully before you access and commence utilization of the LightRemit Application or any functionality or services offered therein as: (i) they apply and govern your use of the LightRemit Application as made available by Inception Technology Co., Ltd. (“Inception Thailand”); (ii) they represent a binding agreement between you (the “User”) and Inception Thailand. By signing up or otherwise registering (“Login”) for the LightRemit Application and utilizing the services made available to you within the LightRemit Application or by clicking to accept or agree to these End-User Terms and Conditions if/when this option is made available to you, you accept and agree to be bound and abide by:

END-USER TERMS AND CONDITIONS

Effective Date: 24 May 2023

The following terms and conditions (the “End-User Terms and Conditions”), governing your access to and the use of the LightRemit Mobile Application including any functionality and services offer on or through the LightRemit Mobile Application are entered into by and between:

  1. INCEPTION TECHNOLOGY CO., LTD., a company incorporated under the laws of the Kingdom of Thailand with company registration number 0105560141177 and having its registered address located at 1760 Sukhumvit Road, Phra Khanong Tai Sub-District, Phra Khanong District, Bangkok (hereinafter referred to as “Inception Thailand”, “We” or “us”); and
  2. THE USER (hereinafter referred to as “You” or the “User”) being a person or entity that has accessed or otherwise utilized any of the functionality or services offered on the LightRemit Mobile Application.

By using the LightRemit Mobile Application, opening an account or by clicking to accept or agree to the End-User Terms and Conditions when this option is made available to You, You accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by the following End-User Terms and Conditions and our Privacy Policy, which is incorporated herein by reference.

  1. DEFINITIONS AND INTERPRETATION
  1. Definitions

In these End-User Terms and conditions, unless otherwise defined or the context otherwise requires, the following words and expressions shall have the following meanings:

Beneficiary” or “Payee” means the person named by the User in the context of a remittance or money transfer transaction conducted utilizing the LightRemit Mobile Application as the beneficiary of the money transfer or Remittance Transaction.

"Force Majeure Event” means any event or sequence of events beyond Inception Thailand’s reasonable control and that could not have been reasonably anticipated or avoided and which prevents it from, or delays it in, performing its obligations under these End-User Terms and Conditions including, but not limited to: acts of God, fire, flood, drought, earthquake, windstorm or other natural disaster, an act of any sovereign including war (or threat of, or preparation for war), armed conflict (of threat of, or preparation for, armed conflict), invasion, act of foreign enemies, hostiles (whether war be declared or not), rebellion, revolution, insurrection, military or usurped power or confiscation; acts of terrorism, civil war, civil commotion or riot (or the threat of, or preparation for, acts of terrorism, civil war, civil commotion or riot); civil emergency (whether an emergency be declared or not); fire or explosion (other than, in each case, one caused by breach of contract by, or with the assistance of, the party seeking to rely on it as a Force Majeure Event); adverse weather conditions; nationalisation, requisition, destruction or damage to property by or under the order of any government or public or local authority; embargo, blockade, imposition of sanctions or severance of diplomatic relations or similar actions; changes in law, or governmental order, rule, regulation or direction, judgment, order or decree; epidemic or pandemic; system failure on the part of Inception Thailand or its payout partners, labour dispute including, but not limited to, strikes, industrial action, lockouts or boycott of a third-party workforce; interruption or failure of utility service including, but not limited to, electric power, gas, water, internet or telephone service;  collapse of building structures;  failure of plant machinery, machinery, computers or vehicles; non-performance by suppliers or sub-contractors; or malicious or negligent damage or other act (other than, in each case, by Inception Thailand seeking to rely on it as a Force Majeure Event).

Fund Deposit” or “Fund Transfer to Inception Thailand” shall refer to the depositing of funds by a User into the bank account nominated by the Service Provider to credit the User Account of the User with funds.

KYC Data” means any information that relates directly to the User. In the case of user’s that are natural persons it shall include information and documentation that relates directly or indirectly to such User that has been provided by the User to the Service Provider (including without limitation: national ID, passport, work permit, temporary house registration book, Non-Immigrant Visa, Smart Visa, government issued document, permanent residence certificate, certificate of identity issued by the government, certificate of employment, or any other documentation provided by the User during the KYC Process. In the case of user’s that are corporates KYC Data shall include personally identifiable information and documents about its directors, shareholders, authorized signatories, authorized representatives or beneficial owners (including without limitation: certificate of incorporation, identification documents of shareholders and directors, corporate documents, register of members, register of directors and any other documents required by the Service Provider in accordance with applicable laws).

KYC Process” means the process undertaken by the Service Provider to onboard the User to allow the User to utilize the services offered within the LightRemit Mobile Application as set out in Clause 2.2 of these End-User Terms and Conditions.

LightRemit Mobile Application” means the platform made available by Inception Technology Co., Ltd., that allows Users to undertake international remittance of funds in the form of Remittance Transactions.

PEP” or “Politically Exposed Person” means someone who is or has been entrusted with any prominent public function in any jurisdiction.

Personal Data” means any information that relates directly or indirectly to an individual who can be identified from the Transaction Data or from that and other information in the possession of either Party, including but not limited to Personal Data of the Sender, the User, the Beneficiary or the Payee, including but not limited to Personal Data of such persons directors, officer, employees, authorized signatories, authorized representatives, shareholders or beneficial owners that such party sends to Inception Thailand.

Regulatory Authority” means any regulatory, administrative, government, quasi-government, supranational, law enforcement or supervisory authority, court or tribunal of any territory, state, or country, or any regional, international, transnational, or supranational organization.

Remittance Transaction” means the transfer of funds from a User to a Beneficiary utilizing the LightRemit Mobile Application as processed by the Service Provider based on the submission of Transaction Data by the User as approved by such User using the Transaction Confirmation Page.

"Sender", “User” or “Service Receiver” shall refer to the individual or entity that has created an account within the LightRemit Mobile Application or has chosen to utilize the remittance or money transfer services offered by the Service Provider

Service Fees” means the fees charged by Inception Thailand via the LightRemit Mobile Application to undertake a Remittance Transaction from the User to the Beneficiary. The Service Fees payable by a User is as shown in the Transaction Confirmation Page prior to the User undertaking the Remittance Transaction. The service fees shall also include any VAT applicable to be included by virtue of applicable law.

Services” means those services made available to the User via the LightRemit Mobile Application offered by the Service Provider as fully set out in Clause 3 of these End-User Terms and Conditions or as offered by the Service Provider from time to time.

"Service Provider" means Inception Thailand. 

Transaction Confirmation Page” refers to a page within the LightRemit Mobile Application to be completed by the User containing the following information: (i) the Transaction Data; (ii) the Service Fees; (iii) the foreign exchange rate applicable to the transaction; and (iv) the total amount to be sent to an account nominated by Inception Thailand in order for Inception Thailand to undertake the Remittance Transaction. Hitting “confirm” or “accept” or otherwise proceeding with the Remittance Transaction after reviewing the Transaction Confirmation Page will issue an order (instruction) to Inception Thailand for making the Remittance Transaction subject always to these End-User Terms and Conditions.

Transaction Data”  means all data collected from the User in relation to a Remittance Transaction conducted by the User using the LightRemit Mobile Application including, without limitation (i) the User’s KYC Data; (ii) the Beneficiary’s name, date of birth, address, telephone number and contact details; (iii) the transfer amount and currency; (iv) the remittance purpose; and (v) such other data that may be required by Inception Thailand’s business partners to process the Remittance Transaction internationally.

User Account” refers to the account created on the LightRemit Mobile Application by the User having undertaken the KYC Process of the Service Provider to access the functionality and services offered within the LightRemit Mobile Application.

User Bank Account” refers to the bank account of a User as registered with Inception Thailand during the KYC Process.

  1. Interpretation

In these End-User Terms and Conditions, unless the context otherwise requires:

  1. reference to a person is, where relevant, deemed to be a reference to or to include, as appropriate, that person’s successors and permitted assignees or transferees;
  2. references to Clauses and Schedules are references to clauses of and schedules to these Terms and a Clause includes a Sub-Clause;
  3. a reference to (or any specified provision of) any agreement, deed or other document is construed as a reference to that agreement, deed or other document as it may be from time to time, amended, varied, supplemented, restated or novated;
  4. words importing the plural shall include the singular and vice versa;
  5. “including” or “includes” means including or includes without limitation;
  6. a “date” shall mean reference to a calendar day;
  7. headings in these Terms are for ease of reference only and are not to be taken into account in the construction or interpretation of these Terms; and
  8. Inception Thailand and the User may be referred to individually as a “Party” collectively as the “Parties”.
  1. REGISTRATION, KYC PROCESS AND USER ACCOUNT OPENING
  1. Who can Register for the LightRemit Mobile Application?

The services offered via the LightRemit Mobile Application are offered and available to users who are 18 years of age or older. If you are under 18 years of age you may not use any of the services made available on the LightRemit Mobile Application. No individual under the age of 18 may use the Services, provide any KYC Data or Personal Data to the Service Provider. By using the LightRemit Mobile Application or any of the Services thereon, you represent and warrant that you are of legal age and are of sound mind to form a binding contract and meet all of the foregoing eligibility requirements.

  1. The KYC Process for Registration
  1. In order for the User to become fully registered as a User of the LightRemit Mobile Application and utilize the Services offered thereon, the User agrees to follow the procedures set out in Clauses 2.2.3 – 2.2.7 (the “KYC Process”) to create a User Account. With regards to how Inception Thailand collects, processes, discloses and destroys all personal data and other data refer to the Privacy Policy. Inception Thailand retains the right to modify how it conducts its KYC Process from time to time.
  1. You acknowledge that Inception Thailand is a financial institution as licensed by the Bank of Thailand and is required to assist in the fight against money laundering activities and the funding of terrorism by obtaining, verifying and recording identifying information about all of Inception Thailand’s customers. Inception Thailand may therefore ask the User to supply us with the personal identifying information relating to the User and the Beneficiary and reserves the right to legally consult other sources to obtain information about the User and the Beneficiary.
  1. Setting up a personal identification number (PIN)
  1. Upon accessing the LightRemit Mobile Application, the User will be required to create a PIN to access the LightRemit Mobile Application and create a User Account. The Service Provider strongly suggests the User to create a strong PIN and periodically review and revise their PIN from time to time.
  1. The User is responsible for maintaining the confidentiality of any and all actions that take place while using your User Account and must notify the Service Provider right away if you notice any unauthorized use of your User Account or PIN. The Service Provider is not responsible for any loss that results from any unauthorized use of your User Account and PIN.
  1. Providing Basic Account Information and Upload of KYC Data and Documentation
  1. The User must provide us with accurate and complete personal information as prompted by the LightRemit Mobile Application. You agree to provide the Service Provider with the following information: name, surname, middle name, alias, etc. 
  1. In providing such information to the Service Provider, you undertake to provide the Service Prover true, accurate and complete personal information. If you fail to provide your personal information to the satisfaction of the Service Provider or the personal information provided by you is in any way untrue, inaccurate, misleading or incomplete, the Service Provider may, at its sole discretion, reject the registration of your User Account and/or may restrict the services made available to you on the LightRemit Mobile Application.
  1. Selfie Process

As part of the User Account creation, the Service Provider will require you to utilize the LightRemit Mobile Application to undertake a proof of liveness check which is conducted by the Service Provider (and/or its licensed service providers) using the selfie feature within the LightRemit Mobile Application.

  1. Processing by Service Provider

Upon completion of the processes outlined in Clause 2.2.3, 2.2.4 and 2.2.5, the Service Provider shall process your KYC Data. The Service Provider reserves the right to contact you utilizing the agreed communication channels (including: email and/or telephone) to confirm your information and/or request additional documents. You acknowledge that where certain information is deemed to be missing or incomplete, you are required to provide such additional documents as requested by the Service Provider.

  1. Physical Validation of Documents

Upon completion of the KYC Process as set out in Clause 2.2.2 – 2.2.5 of these End-User Terms and Conditions, the User will be required to provide copies of its KYC Data to Inception Thailand. Inception Thailand shall contact the User to arrange for the User to complete the final step of the KYC Process in person. You acknowledge that until such time that the User has not completed the physical validation of documents as set out in this Clause 2.2.6, the User shall not be permitted to undertake any Remittance Transactions using the LightRemit Mobile Application.

  1. Your User Account
  1. If the User intend to use the LightRemit Mobile Application as a Sender, you must complete the KYC Process as set out in Clause 2.2 of these End-User Terms and Conditions.
  1. You may be provided with the option to enable account security features and request suspension from the Customer Support Team to protect their account from any authorized usage. The Service Provider strongly suggests that where the option is made available to You, you make use of the account security features.
  1. If the User discovers or otherwise finds any unauthorized login to the User’s User Account, the User must: (i) contact Customer Support at +6620034043 or contact us through the Inception Thailand website; and (ii) immediately change its password/PIN for the User Account on the LightRemit Mobile Application.
  1. Inception Thailand grants the User a non-transferable, non-exclusive license to the use the LightRemit Mobile Application, subject to these End-User Terms and Conditions, our Privacy Policy and the Service specific terms and conditions that may from time to time be made available to the User as may be amended from time to time. We reserve all other rights.
  1. USE OF SERVICES AND PAYMENT OF FEES
  1. Use of the LightRemit Mobile Application
  1. Subject to these End-User Terms and Conditions the User will be able to utilize its account on the LightRemit Mobile Application to undertake Remittance Transactions as processed by Inception Thailand. The Service is available for Remittance Transactions to a wide choice of destination countries and in a wide choice of currencies as set out from time to time on the LightRemit Mobile Application. The Service Provider endeavors to complete transactions within a three (3) business daytime period, subject always to the Remittance Transaction being screened and cleared internally by the Service Provider. 
  1. Should Inception Thailand permit the User to utilize other Services that may be made available through the LightRemit Mobile Application, such Service shall have its own terms and conditions that the User must accept before accessing such Services.
  1. Whilst Inception Thailand intends that the LightRemit Mobile Application should be available 24 hours a day, seven days a week; it is possible that on occasion it may be unavailable to permit maintenance or other development activity to take place or due to any event beyond Inception Thailand’s control. If for any reason Inception Thailand has to interrupt the LightRemit Mobile Application or the Services made available thereon for longer periods that Inception Thailand would normally expect, Inception Thailand will use reasonable endeavors to publish in advance details of such activity on the Inception Thailand website, social media or on the LightRemit Mobile Application.
  1. Initiating a Remittance Transaction
  1. Subject to the End-User Terms and Conditions, the User may undertake a Remittance Transaction utilizing the LightRemit Mobile Application.
  1. In making a Remittance Transaction through the LightRemit Mobile Application, the User must provide the necessary Transaction Data relating to the Remittance Transaction. The User is given an opportunity to review the Transaction Data on the Transaction Confirmation Page.
  1. It is the User’s responsibility to make sure all of the details provided on the Transaction Confirmation page are accurate.
  1. When the User accepts or confirms the Transaction Data utilizing the “confirm” or “accept” button on the Transaction Confirmation Page, the User is requesting that Inception Thailand process the Remittance Transaction based on the Transaction Data provided by the User and the User is consenting to the execution of the Remittance Transaction. The User’s payment instruction will be treated as received by Inception Thailand once the User has accepted the Transaction Data as set out in the Transaction Confirmation Page.
  1. The total amount (the transfer amount, the Service Fees and other applicable fees and charges) that the User must transfer to Inception Thailand and the relevant exchange rate selected by Inception Thailand will be displayed clearly on the Transaction Confirmation Page before you are asked to confirm your Remittance Transaction. This is the amount that the User must deposit into Inception Thailand’s bank account from the User’s Bank Account utilizing the payment channels provided by Inception Thailand.
  1. The User must provide Inception Thailand evidence that the User has successfully transferred the total amount as set out in Clause 3.2.5 for each Remittance Transaction.
  1. Return of Funds and Cancellations of Remittance Transactions
  1. Cancellation of Remittance Transaction by the User
  1. Once Inception Thailand has received the User’s funds from the User’s Bank Account and the User’s instruction to undertake a Remittance Transaction having accepted the Transaction Data as it appears on the Transaction Confirmation Page, the User cannot cancel such instruction.
  1. Notwithstanding Clause 3.3.1(a), Inception Thailand may, in its sole and absolute discretion, attempt to reverse the User’s Remittance Transaction if the User has immediately informed us. In some cases, Inception Thailand may have initiated an irreversible request for funds to be paid out to the Beneficiary using a service provider. In this case, Inception Thailand cannot guarantee that the reversal will be successful.
  1. Inception Thailand can apply a charge for attempting to reverse the Remittance Transaction initiated by the User. Such charge will be deducted from the funds returned to you in the event Inception Thailand is able to cancel the Remittance Transaction.
  1. Payment of Service Fees and Other Charges
  1. For each Remittance Transaction undertaken by us based on the User’s instruction as approved on the Transaction Confirmation Page, the User must pay Inception Thailand the applicable Service Fee (as set out in the Transaction Confirmation Page). Payment of the Service Fees will be included in the funds to be transferred to Inception Thailand using the User’s Bank Account.
  1. If the User initiates a Remittance Transaction based on the User’s instruction as approved on the Transaction Confirmation Page resulting in Inception Thailand becoming liable for charges (including but not limited to chargeback or other fees which Inception Thailand is obligated to pay), the User shall be liable to pay such fee. Such fees shall be deducted from the User’s funds when Inception Thailand return the funds intended for the Remittance Transaction to the User’s Bank Account.
  1. If a Beneficiary’s account is denominated in a currency other than the currency the User instructed Inception Thailand to make payment in there may be delays, additional charges or different exchange rates. These charges may be paid by the User or deducted from the transfer amount to the Beneficiary by the institution receiving the payment.
  1. RIGHTS, RESTRICTIONS, PROHIBITIONS AND ACKNOWLEDGEMENTS
  1. The Rights of Inception Thailand
  1. Our Right to Refuse or Delay Processing a Remittance Transaction

Inception Thailand may refuse any attempted Remittance Transaction, refuse to process any Remittance Transaction initiated by the User using the Transaction Confirmation Page, or delay processing any Remittance Transaction, at any time for any of the reasons set out below:

  1. Inception Thailand is not satisfied that it has the User’s consent to undertake the Remittance Transaction;
  2. Inception Thailand reasonably believes that the User is using (or is allowing someone else to use) the LightRemit Mobile Application, the Service or Inception Thailand’s website, in breach of the User’s (or their) agreement with us as set out in these End-User Terms and Conditions or any applicable laws, rules or regulations, or in furtherance of illegal, fraudulent of prohibited activities;
  3. Inception Thailand has reason to believe that processing any Remittance Transaction initiated by the User would violate anti-money laundering or counter-terrorism financing laws, rules and regulations;
  4. In the case of a payment to Inception Thailand from the User’s Bank Account, Inception Thailand has reason to believe the security of the User’s Bank Account has been compromised or we suspect the unauthorized or fraudulent use of that account;
  5. Inception Thailand is unable to verify the User’s identity or the identity of the Beneficiary (as the case may be). For example, if the User has not accessed the LightRemit Mobile Application, or has not given us instructions in relation to a Remittance Transaction, for one year then for security reasons Inception Thailand may ask the User for additional verification of the User’s identity before processing any Remittance Transaction;
  6. The User does not provide us with any information we have reasonably requested in processing a Remittance Transaction (as explained in Clause 4.1.3);
  7. Inception Thailand reasonably believes there may be fraudulent activity or other financial crime affecting the User;
  8. Inception Thailand is obligated to do so by any law, regulation, court order or instruction from regulators or government bodies;
  9. The User has broken the terms and conditions of its agreement with us as set out in this End-User Terms and Conditions in a way that Inception Thailand reasonably believes justifies refusing or delaying processing any Remittance Transaction;
  10. Inception Thailand reasonably believe that processing the User’s Remittance Transaction would breach these End-User Terms and Conditions or any applicable laws or regulations;
  11. The amount of payment under a Remittance Transaction exceeds any transaction limit that Inception Thailand may apply to such payments to any jurisdiction from time to time;
  12. Inception Thailand reasonably believes that payments are being made either directly or indirectly to certain countries which Inception Thailand have determined, acting in its sole discretion, are high risk to Inception Thailand’s business or involve a higher level or complexity for Inception Thailand in carrying out our anti-money laundering or anti-terrorist financing transaction monitoring process; and
  13. There are insufficient funds provided by the User to Inception Thailand to make the Remittance and/or to cover the Service Fees and any other fees, costs or charges Inception Thailand may incur in making the payment.

Inception Thailand has a right to charge a fee for refusing any Remittance Transaction. Where such a fee applies, it will be set out in the LightRemit Mobile Application or on Inception Thailand’s website.

  1. Our Right to Block Access

Inception Thailand can stop or block the User’s access to and use of the LightRemit Mobile Application if: (i) the User has notified Inception Thailand, or Inception Thailand reasonably believes, that the details used by the User to access its User Account or the LightRemit Mobile Application, has been lost, stolen, compromised, used without authorization or used fraudulently; or (ii) Inception Thailand is obligated to do so by law, regulation, a court order or based on instructions from a regulator or government body.

  1. Our Right to Request Additional Documents for Each Remittance Transaction
  1. Inception Thailand and its payout service providers in each jurisdiction requires certain (and varying) information to be received from the User in relation to the Remittance Transaction. Such information required to be submitted by the User is the Transaction Data.
  1. In addition to the Transaction Data provided by the User in relation to a Remittance Transaction, the User must give Inception Thailand the following information when requested: (i) any and all information that must be provided for a Remittance Transaction to be properly executed; (ii) other information Inception Thailand is required to obtain in order to comply with its obligations under relevant laws, rules and regulations; and/or (iii) information that has been specifically requested from the payout service provider in paying out the Beneficiary of the Remittance Transaction undertaken by the User.
  1. Restrictions Imposed on the User
  1. The User may not be able to use the Services made available on the LightRemit Mobile Application (in whole or in part), if the User is located in certain regions, countries, or jurisdictions. This restriction may also apply where the User is temporarily accessing the LightRemit Mobile Application such regions, countries or jurisdictions (for example when the User is traveling).
  1. You must not use any device, software, jailbreak, root or routine to interfere or attempt to interfere with the proper working of the LightRemit Mobile Application or any Remittance Transaction being conducted through the LightRemit Mobile Application. You may not be able to utilize the LightRemit Mobile Application (in whole or in part) if your device has been jailbroken or rooted.
  1. DISCLAIMER AND LIMITATION OF LIABILITY
  1. The User shall be liable for damages resulting from transfer errors in orders to Inception Thailand, from ambiguities, misuse and other errors that result from the User’s incorrect completion of Transaction Data. The User shall also be liable for occurred damages due to failure to submit to Inception Thailand the supplementary documents or additional data requested by Inception Thailand in accordance with Clause 4.1.3 of these End-User Terms and Conditions.
  1. Inception Thailand shall be liable for damages occurred due to violation of obligations under these End-User Terms and Conditions only in case of gross negligence or intent.
  1. Inception Thailand shall not be liable for the quality of services provided by them through third parties or for damages to the User as a result of the activities (including delays) of third parties (including business partners such as payout partners) in the execution of orders of the User.
  1. Inception Thailand shall not be liable for damages arising from the non-execution of a transaction or for execution not on the due term, occurring due to the fulfilment of an obligations to the Bank of Thailand or the Anti-Money Laundering Office or any other regulatory authority under the law or resulting from failure to follow the instructions or a precept issued by such regulatory authority.
  1. Inception Thailand shall not be liable for damages or decrease in the value of funds, which may occur to the User as a result of changes / fluctuations in exchange rates.
  1. The User shall be responsible for fulfilling the notification obligation and for the correctness of information submitted to Inception Thailand and shall be obliged to compensate Inception Thailand for damages incurred with the provision of false data, late notification of changes in User data or failure to submit changes in the requested form.
  1. Inception Thailand shall not be liable for the violation of obligations, if such violation has been caused by an event of Force Majeure.
  1. MISCELLANEOUS
  1. Ownership and Intellectual Property
  1. The LightRemit Mobile Application, the Services and Inception Thailand’s website, and the content, and all intellectual property relating to them and contained in them (including but not limited to copyrights, patents, database rights, trademarks and service marks) are owned by Inception Thailand, our affiliates or third parties. All right, title and interest in and to the LightRemit Mobile Application, the Services and Inception Thailand’s website will remain our property and/or the property of such other third parties.
  1. The LightRemit Mobile Application, the Services and Inception Thailand’s website may be used only for the purposes permitted by these End-User Terms and Conditions or described on our website or the LightRemit Mobile Application. You are authorized solely to view and to retain a copy of the pages of the LightRemit Mobile Application and Inception Thailand’s website for your own personal use. You may not duplicate, publish, modify, create derivative works from, participate in transfer or sale of, post on the internet, or in any way distribute or exploit the LightRemit Mobile Application, the Services or Inception Thailand’s website or any portion of it for any public or commercial use without Inception Thailand’s express written permission. The User may not: (a) use any robot, spider, scraper or other automated device to access the LightRemit Mobile Application, the Services or Inception Thailand’s website; and/or (b) remove or alter any copyright, trademark or other proprietary notice or legend displayed in the LightRemit Mobile Application or Inception Thailand’s website (or printed pages of the LightRemit Mobile Application or Inception Thailand’s website).

The name “LIGHTREMIT” or “LightRemit” or anyand other name and indicia of ownership of Inception Thailand’s products and/or services referred to in the LightRemit Mobile Application, the Services or Inception website are the exclusive marks of Inception Thailand or the exclusive marks of other third parties. Other products, services and company name appearing on the Inception Thailand website may be trademarks of their respective owners, and therefore the User should not use, copy or reproduce them in any way.
  1. Links to Third Party Websites

The LightRemit Mobile Application may contain links to third-party websites or resources that are not owned or controlled by the Service Prover. The Service Provider has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or resources. The User acknowledges and agrees that the Service Provider is not responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such website or resources.

  1. Severability

If any provision of these End-User Terms and Conditions is deemed illegal or unenforceable, such illegality, invalidity or unenforceability shall not affect the legality, validity and enforceability of any other provision of these End-User Terms and Conditions which shall be construed as if such illegal, invalid or unenforceable provision had not been included in these End-User Terms and Conditions, unless the severability of such illegal, invalid or unenforceable provision would destroy the underlying business purposes of these End-User Terms and Conditions, in which case the parties may negotiate in good faith to substitute such illegal, invalid or unenforceable provisions with a legal, valid and enforceable provision which carries out the original intent of the parties.

  1. Language

These End-User Terms and Conditions are provided in both the English and Thai languages. In the event of any inconsistency between the Thai and English versions of these End-User Terms and Conditions, the Thai language version shall prevail.

  1. Electronic Execution

These End-User Terms and Conditions are being executed electronically and You and Inception Thailand recognizes that the same is validly executed and shall form a binding agreement by You when signing up or otherwise registering for the LightRemit Application and utilizing the services made available to you within the LightRemit Application or by clicking to accept or agree to these End-User Terms and Conditions if/when this option is made available to You. Neither Inception Thailand or You shall claim invalidity of these End-User Terms and Conditions merely on the grounds that these End-User Terms and Conditions are being executed electronically. For the aforementioned purposes, You hereby agree that these End-User Terms and Conditions are being concluded and executed in the Kingdom of Thailand.

  1. Changes and Amendments to this End-User Terms and Conditions

Inception Thailand reserves the right to unilaterally modify the terms of this End-User Terms and Conditions and the terms of each individual service offered within the LightRemit Mobile Application if necessary. The modification of these End-User Terms and Conditions will automatically become effective on the date of its online publication or notification in various electronic forms to You. Any subsequent use of the LightRemit Mobile Application and the services made available to You therein shall constitute a valid User consent to such modification. When Users continue to utilize or enjoy the services after modification or amendment to these End-User Terms and Conditions, User should review and understand the revised contents in a timely manner, and consciously abide by the provisions of these End-User Terms and Conditions. If Users do not agree to the modified content, they should immediately stop using the LightRemit Mobile Application and the services made available by Inception Thailand thereon.

  1. Governing Law and Jurisdiction
  1. The validity, performance, interpretation and dispute settlement of these End-User Terms and Conditions shall be governed by the laws of the Kingdom of Thailand, excluding its conflicts of law provisions.
  1. Any dispute arising out of or in connection with this these End-User Terms and Conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by the courts of the Kingdom of Thailand.
